TERMS & CONDITIONS

These terms and conditions apply to all orders placed by the customer (hereinafter referred to as “you”) with Softtoys by Minicars AB (“Softtoys” “us” or “we”), at Softtoys Online (also referred to as the “website”) hereinafter referred to as the “Terms and Conditions”. Please read our Terms and Conditions carefully before placing any orders on www.softtoys.se. By placing an order, you enter into an agreement with us and accept these Terms and Conditions. We may modify the Terms and Conditions from time to time. If you do not agree to any change to the Terms and Conditions then please immediately stop using the website. Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.

Softtoys stands by Swedish law (2005:59) regarding agreements on distance selling and selling outside of business premises, such as shops, stores and outlets.


HOW TO SHOP ONLINE

Shipping country

You can change country at any time before the final check-out step.
The Softtoys Webshop only offers products that we have in stock. Browse the site to select the items you like and add them to your shopping bag. Please note that all orders are subject to availability, and items in your shopping basket are not reserved and may be purchased by other customers until you have completed all check-out steps.
You can always view, change or delete items in your shopping bag before you proceed to the check out.

Registration

To be able to place an order from the website you will be asked to register and provide your personal details. You must provide your real name, phone number, e-mail address and other requested information as indicated. You are required to provide information about yourself that is true, accurate, current, and complete in all respects. Should any of your registration information change, please update your personal details at www.softtoys.se or notify us immediately by calling or via email info@softtoys.se. We may change registration requirements from time to time.

Submitting your order

Before proceeding to payment, you can review your order (including your total price inclusive of VAT and shipping charges) and make changes if needed. You may choose to provide us with contact details such as your mobile phone number or email address for delivery notification.
You are bound by your order from the moment you accept the online offer of Softtoys and the conditions thereby stipulated have been fulfilled (once the order has been submitted and payment confirmed on the website or via Softtoys via telephone). Please note that the order will not be valid if Softtoys cannot confirm the billing and shipping addresses that you provide. We also reserve the right to only accept orders from those aged over 18 years old.
Orders must be placed online or via telephone to Customer Service. Softtoys do not accept order via email.

Payment

Payment towards online store purchases can be made with a valid card by a provider accepted by Softtoys online. You will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the billing information provided. The total order sum will be checked and reserved against your credit/debit until the time of dispatch from our warehouse. Softtoys reserves the right to restrict multiple quantities of an item, or of orders, being shipped to any one customer or postal address.
The same payment terms apply to customers placing their order online as well as via telephone. We do not accept orders via email.

Order confirmation

You will receive an immediate online confirmation on your screen at the end of the check-out, as well as an email confirmation of your order from Softtoys.

Changes to your placed order

We aim to be fast at picking and packing, so please note that once your order has been placed and you have received an order confirmation email, you may not make any changes to your order. If you wish to make changes to your placed order, or if there is any mistake made in registering customer contact or address details when placing the order, it is your responsibility to contact Softtoys immediately.

PRICING POLICY AND CHARGES

Prices are shown in SEK (Svensk Krona) for all shipping countries.
All prices displayed in the Softtoys Webshop include country specific Value Added Tax (VAT) and exclude shipping fees. The shipping fees will be added to the order in the check-out step and might differ based on which country your order is shipped to. Please find more information about our delivery charges for each country under section 4 (Delivery and Shipping).

PAYMENT

Orders placed against a VISA card or MasterCard can be processed online or via the telephone. We only accept cards with billing addresses in one of the countries that Softtoys ships to, in addition to cards registered to an address in Norway, Luxembourg or Switzerland. Please note that we cannot accept any other payment methods.

When paying by card, Softtoys reserves the right to check the validity of the card, that there are enough funds to cover the purchase sum, and validate the billing address details of the purchaser. Softtoys reserves the right to deny any purchase. Your card will only be debited after your order has been dispatched from the warehouse. The currency used is Swedish krona (SEK). VAT is included in all our prices and will be updated on the online store, when you select shipping country.

Please note that all prices and product information on softtoys.se are subject to change. We cannot provide information about, or guarantee item availability in our stores via the website. If you are a customer whose card is not denominated in SEK (Swedish kronor), the final transaction amount will be calculated in accordance with the applicable exchange rate on the day your card issuer the transaction.

DELIVERY AND SHIPPING

Select the country where you would like your items to be delivered in the check out. If you have already added items to your shopping bag they will not disappear if you change your shipping destination. Please note that all prices, VAT, delivery times and delivery charges will be adjusted depending on the country you would like your items shipped to.

Softtoys will take the greatest of care to be as accurate as possible when receiving and dispatching orders.
Softtoys will dispatch the approved orders as quickly as possible and in the order that they have been received. Delivery normally takes about 3-6 working days from the time of placing the order. Delivery times may vary depending on where the order is to be delivered, though the latest within 30 days from order date.

Please note that we only sell items that we have in stock. Products may sell out during the shopping session, and stock availability will be updated once you reach the check-out. We aim to dispatch all orders within 24 hours (Monday – Friday) with the exception of sale and peak periods where this may take longer. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. Softtoys is not responsible for any delays caused by destination customs clearance processes.

If a delivery suffers a delay or if the delivery cannot be dispatched or only partially due to the goods not being in stock or other reasons, the consumer will be informed about this as quickly as possible or at the latest 30 days after the order was placed. In this case, the consumer will be given the option and has a right to terminate the agreement, free of charge. In the case of termination in accordance with this paragraph, Softtoys will refund the consumer with the sum paid as quickly as possible, though at the latest within 30 days after termination.
The place of delivery is deemed to be the address that the consumer makes known to Softtoys at the time of registering personal details and placing the order.

Please note that we only ship to home or office addresses and not to P.O. box addresses.

Shipping destinations and shipping fees

Shipping fees specified in SEK will be displayed in checkout. We do not ship to the over-sees territories marked as ‘excl.’ in brackets below.

Note that every fee means per parcel. We aim to pack your orders in the most efficient way, but have a size limit of 300 cm per parcel.

RIGHT OF RETURN/CANCELLATION

Our policy

You have the right to cancel your purchases within a period of 14 calendar days after the day of delivery of the goods. which means that you are allowed to change your mind and send back the goods you have received, without any obligations from your side, apart from the return shipping fees. We trust that you will treat the product and its packaging with care - please return items undamaged and unused, with all Softtoys labels and tags intact.
Returns that are damaged, soiled or washed may not be accepted and may be sent back to the customer and/or a refund refused.

Pre-paid return postage

A pre-paid return address label will be send to you if you wish to return your products. When we have approved your returned item, the return postage of 90SEK will be deducted from your refund. Please remember that financial responsibility for the return is yours until it reaches us.
Unidentified returns may not be eligible for a refund. For faulty items Softtoys will make a full refund to you as soon as possible upon receipt of the goods and within 30 days, beginning with the date of receipt of the goods.
Cut out the pre-paid returns label and attach to the outside of the parcel, making sure that you cover the original address label. Please note that we suggest you to use the original packaging if possible.

Please hand the parcel in at a Post Office.

Faulty goods

Goods are faulty if they are received damaged or where a manufacturing fault occurs within 3 years of purchase. Items that are damaged as a result of normal wear and tear are not considered to be faulty. If you are returning a faulty item, you are entitled to a full refund including costs for return.

COLOURS

We have made every effort to display as accurately as possible the colours of our products that appear on softtoys.se. If there are colour differences between the colours shown on the website on your computer and the actual colours of the products, this may be due to the colour reproduction on your computer.

TRANSPORT WARRANTY

All consignments that are sent are insured by Softtoys. If you discover any damage to the package before you open it, you must report this to the forwarding company, or for shipments to Sweden and Denmark the collection point where you picked up your consignment. If you have already opened the consignment when you discover the damage, you must contact us.

MINIMUM AGE

In order to shop at Softtoys online store you must be at least 18 years old.

PROTECTION OF PRIVACY

The Data Protection Act 1998 sets out requirements for how we store and disclose your personal information. Softtoys holds responsibility for all personal information that you make available to us. The details are used for verifying, accepting and processing delivery agreements and for managing the customer relationship thereby arising, pursuing outstanding payments, combatting fraud and misuse and complying with statutory regulations.
Softtoys does not pass on any information to a third party. You can make a request to see the personal details that we have for you by emailing info@softtoys.se.

Softtoys uses SSL (Secure Socket Layer), which means that all orders are encrypted, ie completely secure.


APPLICABLE LAW

These Terms and Conditions and all disputes arising in connection with these Terms and Conditions or with the use of the website or with any purchase on the website shall be governed by Swedish law.
You are therefore asked to accept only the Terms and Conditions applicable at the time of purchase with each of your orders.

OWNERSHIP OF RIGHTS

All rights, including copyrights at softtoys.se remain with Softtoys By Minicars AB. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without our permission.
